50% of Managers Risk Prosecution

A recent survey of NHS, Local Authority and Housing sector managers researching the methods and practices for lone working and carried out by Glasgow University shows that less than 50% of business managers understand the current legislation, current industry standards and therefore the potential business impact and relevance of non-compliance. Amongst other key findings it is also clear that managers have very little understanding of the key components required in the design of a robust lone worker solution.

The Sentencing Guidelines Council (SGC) has published a definitive guideline on the sentencing of corporations (rather than individuals) for corporate manslaughter under the Corporate Manslaughter and Corporate Homicide Act 2007 (CMCHA came into force on 6th April 2008) and health and safety offences which result in death contrary to sections 2 and 3 Health and Safety at Work Act 1974 (HSWA).

There were 95,000 physical and verbal assaults last year by patients and their families. Argyll welcomes the introduction of any solution designed to improve Lone Worker safety but be careful warns Argyll CEO, Tom Morton; "This particular approach may not necessarily meet the duty of care requirement. The reliance on a single device to fulfil a duty of care obligation is in itself fundamentally risky. Primarily the function of any device should be to fulfil the duty of care and additionally provide the means to reliably raise an alert or summon assistance when needed…Our experience managing over 25,000 lone workers across many different sectors, indicates that the need to summon assistance equates to only a very small percentage of the total employers duty of care requirement and comply with the recent Corporate Manslaughter legislation.
